These Terms of Service ("Terms") govern your use of OutSends β the
Chrome extension, the web application at app.outsends.com, the backend API, and any
related service (collectively, the "Service"). By installing,
accessing, or using the Service, you agree to be bound by these Terms. If you do not
agree, do not use the Service.
1. Acceptance of Terms
By accessing or using OutSends, you confirm that:
- You are at least 16 years of age
- You have the legal authority to enter into these Terms (on your own behalf or on behalf of an entity you are authorized to bind)
- You will comply with all applicable local, national, and international laws
- The information you provide to OutSends is accurate, complete, and current
2. Description of Service
OutSends is a productivity utility that helps Gmail users send personalized email campaigns (mail merge) from their own mailbox, with built-in compliance safeguards. Features include:
- Composing and sending personalized campaigns from your connected Gmail account
- Managing contact lists and email templates
- Sequences and automated follow-ups
- Engagement tracking (opens, clicks, replies, bounces)
- Multi-sender rotation and team workspaces (paid plans)
OutSends does not provide email hosting or email addresses. Sending always occurs from your own Gmail or SMTP account.
3. Service Availability

The Service is provided "as is" and
"as available" without warranties of any kind, express or implied.
We do not guarantee:
- Uninterrupted or error-free operation
- Email deliverability or inbox placement
- Specific open rates, click rates, or campaign performance
- Compatibility with every email client or recipient
Deliverability depends on many factors outside our control, including your sender reputation, content, recipient provider, and sending volume.
4. Acceptable Use
You agree to use OutSends only for lawful, ethical, and consent-based outreach. Specifically, you agree to:
- Comply with all applicable email-marketing laws β including CAN-SPAM (US), GDPR and ePrivacy (EU), CASL (Canada), PECR (UK), and any local equivalent
- Obtain valid consent before adding contacts to your lists; never use purchased, rented, scraped, or otherwise non-consented lists
- Honor unsubscribe requests promptly (and in any case within the time limits set by applicable law)
- Identify yourself accurately in every message; never use deceptive headers, sender names, or subject lines
- Respect the OutSends per-sender daily quota and the published Gmail sending limits β circumventing or attempting to circumvent these limits is prohibited
- Maintain the security of your credentials and your connected sender accounts
5. Prohibited Conduct
You may not use the Service to send, store, host, promote, distribute, or facilitate any of the following:
- Spam, phishing, malware, or fraudulent or deceptive content
- Content that infringes intellectual-property rights of others
- Content that promotes violence, terrorism, hate speech, harassment, or unlawful discrimination on any basis (including race, religion, ethnicity, nationality, gender, sexual orientation, or disability)
- Sexually explicit material, content involving minors in any unsafe context, or content that exploits any vulnerable group
- Content that violates the privacy or other legal rights of recipients or third parties
- Any activity prohibited by Google's User Data Policy, the Chrome Web Store policies, or applicable law in your jurisdiction or the recipient's jurisdiction
5.1 Ethical and Religious-Compliance Clause
OutSends is operated under principles of ethical use. As a condition of access, you further agree not to use the Service to promote, facilitate, or distribute content or transactions that are unlawful or unethical under widely recognized religious and moral standards β including, by way of example and without limitation, content or commerce that would be considered haram under the principles of Islamic law (such as riba-based financial schemes, gambling and games of chance, fraudulent or deceptive offers, content promoting alcohol or other prohibited substances, sexually exploitative material, or any content offensive to religious or ethical communities).
This clause is global, faith-respectful, and intended to keep OutSends a clean, professional channel that any recipient β of any background β can trust.
6. Enforcement, Restrictions, Suspension & Termination
OutSends takes abuse seriously. We continuously monitor for violations through automated signals (bounce and complaint rates, content scans, deliverability metrics) and through manual abuse reports.
6.1 Tiered enforcement
Where possible, enforcement is tiered. We may, at our sole discretion, take any of the following actions:
- Warning & required correction β for first or minor violations, we will notify you and require corrective action within a reasonable deadline.
- Feature restriction β we may temporarily disable specific capabilities (sending, sequences, AI assistant, custom tracking domain) while we investigate.
- Quota reduction β we may lower your daily sending cap to protect deliverability.
- Temporary suspension β we may suspend your account for a defined period.
- Permanent ban β we may permanently terminate your account and revoke all access for the user, the associated email address(es), and any account that we identify as a circumvention attempt.
- Reporting β we may report abuse to email providers, relevant authorities, or law-enforcement agencies as required.
6.2 Immediate action for severe abuse

For severe or repeated abuse β including spam at scale, phishing, malware distribution, illegal content, sustained high complaint rates, or any violation of section 5 β OutSends may suspend or permanently ban your account immediately and without prior notice, and may withhold pending campaigns.
6.3 No refund for terminated accounts
Accounts terminated for breach of these Terms or the Anti-Spam Policy are not eligible for refunds, including for unused portions of paid plans.
6.4 Voluntary termination
You may terminate your account at any time from Settings > Account > Delete account. Upon deletion, your data is removed in accordance with the Privacy Policy.
7. User Content & Responsibility
You retain ownership of the content you create and the contact data you upload. You grant OutSends a limited, non-exclusive license to host, transmit, and process this content solely to operate the Service for you. You are solely responsible for:
- The legality and accuracy of every message you send
- Obtaining lawful consent from your recipients
- The consequences of your sending practices, including any reputational, deliverability, or account impact on your own Gmail or SMTP accounts
8. Plans, Pricing & Billing
- Paid plans are billed in advance through our payment processor (LemonSqueezy)
- Quotas reset on the billing-cycle anniversary; unused quota does not roll over
- We may adjust pricing or plan limits with reasonable advance notice
- Refund policy: pro-rata refunds may be offered at our discretion for service failures attributable to OutSends; refunds are not granted for breach-related terminations
9. Changes to the Service
We continuously improve the Service and may add, modify, or remove features at any time. We will make reasonable efforts to communicate material changes in advance.
10. Intellectual Property
All rights, title, and interest in the OutSends Service β including code, design, branding, and documentation β belong to OutSends. You may not:
- Copy, modify, or distribute the Service's source code
- Reverse engineer or decompile the software (except where prohibited from being prevented by law)
- Use the OutSends name, logo, or branding without prior written permission
11. Limitation of Liability
To the maximum extent permitted by law:
- OutSends is not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not responsible for lost revenue, data loss, email account suspensions, deliverability outcomes, or reputation damage resulting from your use of the Service
- Our total aggregate liability shall not exceed the greater of (a) the amount you paid OutSends in the 12 months preceding the claim, or (b) USD 100
12. Indemnification
You agree to indemnify and hold OutSends, its officers, employees, and contractors harmless from any claim, damage, loss, or expense (including reasonable legal fees) arising from:
- Your violation of these Terms or any policy referenced herein
- Your email-sending activities and the content you send
- Your violation of any third-party right, including privacy or intellectual-property rights
13. Governing Law & Disputes
These Terms are governed by the laws of the jurisdiction in which OutSends is operated, without regard to conflict-of-laws principles. The parties agree to submit to the exclusive jurisdiction of the competent courts of that jurisdiction, except where mandatory consumer-protection laws of your country of residence provide otherwise.
14. Severability & Entire Agreement
If any provision of these Terms is held invalid, the remaining provisions remain in full force. These Terms, together with the Privacy Policy and the Anti-Spam Policy, constitute the entire agreement between you and OutSends regarding the Service.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the extension or by email. Continued use of the Service after the effective date of an update constitutes acceptance of the updated Terms.
